Over 180+ Wake County DWI Cases Tossed as Troopers Face Credibility Scandal

RALEIGH, NC – The credibility of two North Carolina State Troopers is under fire, leading Wake County prosecutors to dismiss over 180 court cases, primarily driving while impaired (DWI) charges, with more dismissals expected.

The significance

The cases, many of which stem from Trooper Garrett Macario’s past charges, underscore the justice system’s reliance on credible testimony from law enforcement.

“To be unable to proceed in these cases is incredibly disappointing and frustrating,” said District Attorney Lorrin Freeman. However, the district attorney emphasized her office’s duty not to rely on witnesses whose credibility is doubtful.

The trigger

Macario is at the center of an investigation after body and dashcam footage from an October 2024 fatal car crash on Capitol Boulevard in Raleigh raised questions about his honesty. The footage allegedly shows Macario providing false or misleading information to Raleigh police officers at the scene.

The fallout

Freeman’s findings prompted the dismissal of dozens of cases last week and a review of cases tied to Sgt. Matthew Morrison, who, along with Macario, was placed on administrative leave on January 10. More dismissals may follow as the investigation continues.

From hero to scrutiny

Macario was once celebrated for his exemplary performance. In 2021, Garner Local Heroes recognized his work, noting that in 2020 alone, he made 133 DWI arrests and issued hundreds of citations for reckless driving and other violations. This investigation has now cast a shadow over his previously celebrated career.

Freeman has initiated a probe with the State Bureau of Investigation, and the fallout continues to mount. “In an era of body cam and dashcam video, the evidence can be clear even before an investigation is complete,” Freeman noted, highlighting the growing role of transparency in holding law enforcement accountable. Meanwhile, the credibility of Troopers Macario and Morrison remains under scrutiny, casting doubt on their involvement in numerous cases.
