NC Mail-In Voting Rules Explained As Trump Court Battle Fuels Confusion Before Election

With North Carolina absentee ballots already going out and federal courts weighing proposed restrictions on how the U.S. Postal Service handles ballot mail, voting advocates are urging residents to understand the rules, act early, and double-check every requirement before returning their ballots.

During this week’s episode of PC Politics — Real. Raw. Relevant., Spectacular Magazine CEO and Publisher Phyllis Coley spoke with Jean-Patrick “JP” Grillet, Election Protection Manager for Democracy North Carolina; Marcus Bass, Deputy Director of the North Carolina Black Alliance; and Dan Crawford, Senior Director of Public Affairs for the North Carolina League of Conservation Voters.

The panel explained how absentee voting works, highlighted critical deadlines and examined whether increasingly complicated procedures could discourage eligible North Carolinians from voting.

Absentee Voting And Mail-In Voting Mean The Same Thing

Grillet began by clearing up one of the most common sources of confusion: In North Carolina, an absentee-by-mail ballot is what many voters call a mail-in ballot.

“Those are not two different things,” Grillet said. “Absentee ballots are mail-in ballots.”

Any registered North Carolina voter may request an absentee ballot. Voters do not need to provide a reason or prove they will be away from home on Election Day.

A voter may submit an absentee-ballot request through the state’s online portal or complete an official paper request form and deliver it to the appropriate county Board of Elections.

The deadline to request an absentee ballot for the November 3 general election is 5 p.m. Tuesday, October 20. However, waiting until the deadline could leave very little time to receive, complete and return the ballot.

Two Witnesses Or A Notary Are Required

North Carolina voters must carefully follow the instructions included with their absentee ballots.

A voter must mark the ballot in the presence of either:

• Two witnesses who are at least 18 years old, or
• One notary public

The witnesses should observe the voter marking the ballot—but should not observe how the person votes. Each witness must sign and print their name and provide a complete address on the ballot envelope.

The voter must also sign the envelope.

“Each and every single election cycle, we’re seeing changes to our voting process,” Bass said, arguing that the increasingly detailed requirements make it easier for voters to commit an unintentional error.

“These are all very valid questions,” he added. “They made the rules by design complicated to keep people from voting.”

Voters Must Include Photo Identification Documentation

For the 2026 election, absentee voters must place a copy of an acceptable photo ID in the clear sleeve provided on the back of the ballot envelope.

A voter who cannot provide an acceptable ID copy may complete the yellow Photo ID Exception Form included in the absentee-ballot package and place that form in the clear sleeve instead.

Grillet said the exception form remains available during the 2026 election, including for eligible voters whose disability prevents them from providing an ID copy.

The ballot itself should be sealed inside the designated ballot envelope. Voters should follow the enclosed instructions carefully and avoid placing unauthorized materials inside the ballot envelope.

A Postmark Is Not Enough In North Carolina

One of the most important points from the conversation involved North Carolina’s ballot-receipt deadline.

Completed absentee ballots must be received by the voter’s county Board of Elections no later than 7:30 p.m. on Election Day—Tuesday, November 3.

A ballot merely postmarked by Election Day will not automatically qualify.

“There used to be a grace period for absentee ballots to arrive,” Grillet explained. “A few years ago, they made the deadline much stricter.”

Because North Carolina no longer provides that post-election grace period, voters who plan to use the Postal Service should return their completed ballots as early as possible.

Return postage for the 2026 general election is $1.98, according to the State Board of Elections. Three Forever stamps will cover that amount.

Voters may monitor their ballot’s status through BallotTrax, which tracks a ballot from issuance through acceptance.

Voters Can Return Their Ballots In Person

Voters who do not want to depend on mail delivery may personally return their completed ballots to:

• Their county Board of Elections office; or
• An authorized early-voting site in their county during the early-voting period

Early voting runs from Thursday, October 15, through Saturday, October 31.

Absentee ballots cannot be returned to an Election Day polling place. On Election Day, they must be delivered to the county Board of Elections office by 7:30 p.m.

Generally, only the voter, a near relative, or a legal guardian may mail or hand-deliver the voter’s return envelope. Voters should not give their ballots to neighbors, friends, campaign workers or strangers for delivery.

Federal protections permit voters who need assistance because of a disability to select someone they trust to assist them. Additional certification requirements may apply.

Grillet encouraged voters returning ballots in person to ask election workers to review whether all required sections of the envelope have been completed.

“Double- and triple-check that you did everything correctly with the county Board of Elections,” he advised.

Federal Court Battle Adds Another Layer Of Uncertainty

The PC Politics discussion occurred as the Trump administration continued seeking permission to enforce new Postal Service requirements governing federal ballot mail.

The proposed rule would require election officials to submit information about mail-ballot recipients through a federal portal and use envelopes meeting specific design and barcode requirements. Ballots that fail to comply could be returned to election officials instead of being delivered to voters.

Critics contend the system was developed too quickly and could prevent eligible voters from receiving their ballots. The administration describes the requirements as election-integrity safeguards.

Bass argued that the Postal Service should not be responsible for evaluating a voter’s eligibility.

“The U.S. Postal Service should not be an intermediary for your election,” Bass said. “They should literally just be handling the mail.”

Since the interview was recorded, the 1st U.S. Circuit Court of Appeals has upheld a lower court order preventing enforcement of the new requirements during the 2026 election. The Supreme Court is separately considering the administration’s request to intervene. Reuters

For now, the federal litigation has not changed the steps North Carolina voters must follow when requesting, completing or returning an absentee ballot.

Advocates Warn Black Voters Could Face Greater Barriers

Bass said complicated requirements and last-minute changes frequently place heavier burdens on Black voters, seniors, people with disabilities, rural residents, members of the military and students living away from home.

“Whenever America catches a cold, Black America catches the flu,” Bass said. “Whenever voter suppression has wreaked havoc across the country, Black voters are going to be in a voter depression.”

He pointed to Black churches, Divine Nine organizations, neighborhood associations and community groups as trusted institutions that can help voters understand the requirements and develop voting plans.

“They’re the influencers in the community,” Bass said. “They’re the people that, by virtue of two or three phone calls, can move hundreds of people.”

Bass called for volunteers throughout North Carolina to help educate voters, monitor elections, and mobilize their communities.

“We’re going to be encouraging, we’re going to be protecting, and we’re going to be moving people to the polls in all the safe, legal, compliant, nonpartisan ways,” he said.

Voting Rights Connect To Every Public-Policy Issue

Crawford addressed why an environmental organization such as the North Carolina League of Conservation Voters participates in democracy and voter-engagement work.

“We are about supporting democracy and getting everybody out to the polls because who we elect matters,” Crawford said. “If you want to drink clean water, if you want to breathe clean air, that affects everybody.”

He urged voters to select the lawful voting method that works best for them—absentee voting, early voting or Election Day voting—and encourage others to participate.

“Talk to your friend,” Crawford said. “Have you voted yet? Do you have a plan to vote? Come vote with me.”
